Terms of Service
Services Provided
We offer tattoo design and application services through our Studio. By using our services, you agree to follow the guidelines set by Erin's Tattoos, including any specific requirements or conditions associated with the services, such as health considerations, age restrictions, and the type of tattoos we offer.
Eligibility
You must be at least 18 years of age to book a tattoo session with us.
Booking Appointments
a. Appointment Scheduling
You may book tattoo appointments through our Site or by contacting us directly. We require that you provide accurate and complete information when scheduling your appointment.
b. Booking Confirmation
Once an appointment is scheduled, you will receive a confirmation email. If for any reason we are unable to accommodate your appointment, we will notify you as soon as possible and offer you an alternative date or time.
c. Deposits
To secure your tattoo appointment, a non-refundable deposit may be required. The deposit amount will be specified at the time of booking. This deposit will be credited toward the total cost of the tattoo service.
d. Cancellations & Rescheduling
If you need to cancel or reschedule your appointment, we ask that you provide at least 48 hours’ notice. Cancellations or rescheduling requests made less than 48 hours before the appointment may result in the loss of your deposit. Please note that if you miss an appointment without notifying us in advance, you may be charged a no-show fee.
Payment
a. Payment Methods
We accept payment by credit card, debit card, Venmo, and cash. Full payment for your tattoo session is due upon completion of the tattoo. The cost of your tattoo will be communicated prior to the appointment, including any additional fees for custom designs or larger pieces.
b. Pricing
Tattoo prices are determined based on the size, design complexity, and time required to complete the work. You will be given an estimate of the total cost before the appointment begins. Final pricing will depend on the actual time spent and any additional requests or changes during the session.
Health & Safety
a. Health Conditions
By booking a tattoo with us, you confirm that you are in good health and do not have any medical conditions that may affect your ability to receive a tattoo. You must inform us of any medical conditions, allergies, or medications that may interfere with the tattoo process.
b. Age Verification
You must be at least 18 years of age to receive a tattoo. We create a copy of your legal state or federal ID to verify you are over the age of 18 and for consent records.
c. Aftercare
You are responsible for following the aftercare instructions provided by our artists to ensure proper tattoo healing. We are not liable for infections, poor healing, or other issues arising from improper aftercare.
Intellectual Property
Ownership of Tattoo Designs and Artwork
All tattoo designs created by our artists (whether custom or pre-existing designs) are the intellectual property of Erin’s Tattoos or the individual tattoo artist who created them.
Design Ownership
Custom Designs: If you commission a custom tattoo, the design will be owned by the artist who created it, unless otherwise agreed in writing. Upon completion of your tattoo session and full payment, you are granted a license to use the tattoo design on your body. This license is non-transferable and non-exclusive.
Pre-existing Designs: Any tattoo design that is part of our studio’s portfolio, pre-drawn collection, or available through our website is also the intellectual property of Erin’s Tattoos or the artist who created it. These designs are available for your use only through the tattooing process.
License for Personal Use are granted a personal, non-commercial, non-exclusive license to use the tattoo design on your body. This means you have the right to have the tattoo inked on your skin, but you cannot reproduce, modify, sell, or use the tattoo design for commercial purposes without the written permission Erin’s Tattoos. We reserve the right to display the design in our portfolio or on our website for promotional purposes unless otherwise agreed upon in writing.
Copyright Infringement
and Enforcement
If you violate this Intellectual Property Policy or use the tattoo design in a manner not authorized by the artist, Erin’s Tattoos or the artist reserves the right to take legal action. This may include sending a cease and desist notice, seeking injunctive relief, and/or pursuing claims for any damages incurred due to the unauthorized use of the intellectual property.
Transfer of Intellectual
Property Rights
The intellectual property rights to the tattoo design will not be transferred to the client unless there is an explicit written agreement in place, stating the terms under which the design’s ownership is transferred. This could include cases where the client requests exclusive rights to a design for a higher fee or specific arrangements.
Exceptions:
Any exceptions to this Intellectual Property Policy must be agreed upon in writing by both the client and the artist at Erin’s Tattoos. This may include a formal contract or license agreement that grants the client specific rights to use the design in a way not covered by this policy.
Termination of Rights
If at any time the client engages in behavior that infringes on the artist's or Erin’s Tattoo’s intellectual property, including commercializing or reproducing designs without permission, the license granted to use the design on the client’s body may be revoked. The artist may also take appropriate legal action to protect their intellectual property rights.
Usage of Designs After Tattooing
After your tattoo is completed, you may:
Display the tattoo on your body.
Share images of the tattoo on social media, provided you give credit to the artist if possible.
Take personal photos for non-commercial use.
However, you may not:
Reproduce the tattoo for sale or commercial use without written permission from the artist.
License or authorize third parties to use the tattoo design for any purpose, including but not limited to mass reproduction, marketing, or promotional use.
Artist’s Rights and Portfolio Use
Artist, Erin’s Tattoos and our artists retain the right to:
Display Tattoo Designs: We reserve the right to display tattoo designs (including custom pieces) in our portfolio, on our website, and across our social media platforms for promotional and marketing purposes.
Document Tattoo Sessions: Our artists may photograph or take videos of the tattoo process and the finished design, which may be shared on social media, websites, or other promotional materials. If you prefer not to have your tattoo shared publicly, you must inform us before the tattoo is completed, and we will honor your request.
Create Similar Designs: The artist may, at their discretion, create similar or identical designs for other clients, but will ensure that each tattoo is a unique, personalized experience for the customer receiving it.
Modification of Designs
You may request a modification or adaptation of the tattoo design. However, the modified design will still remain the intellectual property of [Your Tattoo Business Name] or the artist, and the same terms and conditions apply to the new design. You cannot claim ownership over modified designs unless explicitly agreed upon.
Behavioral Expectations
a. Conduct During Appointment
We expect all clients to behave respectfully during their appointment. Any form of verbal or physical abuse toward our staff or other clients will result in immediate termination of the session, and you may be asked to leave the premises without a refund.
b. Right to Refuse Service
We reserve the right to refuse service to anyone for any reason, including but not limited to improper conduct, intoxication, or if the tattoo artist believes the client is not a good fit for the design requested.
Limitation of Liability
a. Risk Acknowledgment
You acknowledge that getting a tattoo involves inherent risks, including infection, scarring, and allergic reactions. While we take every precaution to ensure your safety, you accept these risks and agree that Erin’s Tattoos is not responsible for any complications arising from the tattoo process.
b. Limitation of Liability
In no event shall Erin’s Tattoos be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to lost profits, loss of data, or injury.
Privacy & Data Protection
We collect and process your personal data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your personal information as described in the Privacy Policy.
Termination
